Introduction & Acceptance

These Terms and Conditions (“Terms”) govern your access to and use of the Maared platform, including the website maared.sa, mobile applications, and any related services (collectively, the “Platform”), operated by Maared Trading Company, a company registered in the Kingdom of Saudi Arabia under Commercial Registration No. 1010XXXXXX.

By creating an account, placing a bid, booking a test drive, or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Platform.

These Terms apply to all users: individual car buyers, showroom owners, authorized dealership representatives, and visitors.

Definitions

The following terms carry the specific meanings set out below wherever they appear in these Terms:

Buyer

A natural person using the Platform to browse, bid on, or purchase vehicles.

Seller / Showroom

A licensed car dealership or authorized showroom listing vehicles for sale or auction on the Platform.

Auction

A time-bound bidding event in which registered Buyers place competitive bids on a listed vehicle.

Bid

A binding financial offer submitted by a Buyer during an Auction, equal to or above the current bid increment.

Winning Bid

The highest valid Bid received at the moment an Auction closes.

Deposit

A refundable amount held to enable participation in Auctions, as set out in Section 05.

Listing

A vehicle record published by a Showroom, including photos, specifications, price, and condition.

Eligibility & Account Registration

You must be at least eighteen (18) years of age and legally capable of entering into binding contracts under the laws of the Kingdom of Saudi Arabia to create an account.

You must provide accurate, current, and complete information during registration, including a valid Saudi national ID or Iqama number, a Saudi mobile number verified by OTP, and a residential address within the Kingdom.

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Maared will not be liable for any loss arising from unauthorized account use due to your failure to maintain credential security.

Maared reserves the right to suspend, restrict, or terminate any account found to contain false information, to be operated by a party other than the registered holder, or to be used in violation of these Terms.

Using the Platform

The Platform provides tools to browse vehicle listings, save favorites, maintain a watchlist, contact Showrooms, book test drives, and participate in Auctions. Use of these features is subject to these Terms and any feature-specific guidelines published on the Platform.

Listings, prices, and availability are provided by Showrooms and may change without notice. While Maared verifies the identity and licensing of Showrooms, it does not independently inspect each vehicle and makes no warranty as to the condition, history, or title of any vehicle listed.

Test drive bookings are coordinated directly between the Buyer and the Showroom. Maared is not a party to the test drive and accepts no liability for any incident, damage, or dispute arising during or from a test drive.

Auction Rules

Every bid you place is final and legally binding. It cannot be retracted or cancelled.

Participation in Auctions is governed by the rules set out in this Section, which apply in addition to the general Terms. By placing a Bid, you acknowledge and accept these rules in full.

Binding Bids

Every Bid is final and binding the moment it is submitted. Bids cannot be retracted, reduced, or cancelled for any reason, including change of mind, financing issues, or subsequent discovery of information about the vehicle.

Deposit Requirement

A refundable deposit of SAR 2,000 is required to enter any Auction. The deposit is returned within seven (7) business days if you do not win, and is applied toward the purchase price if you do.

Bid Increments

Bids must meet or exceed the minimum increment displayed on the Auction page, typically SAR 500 or SAR 1,000 depending on the current price tier.

Winning Obligations

The Winning Bidder must complete payment of the full balance within seventy-two (72) hours of Auction close. Failure to do so results in forfeiture of the deposit, a twelve-month ban from all Auctions, and potential legal action for damages.

Reserve Prices

Some Auctions carry an undisclosed reserve price. If the Winning Bid does not meet the reserve, the Showroom may elect not to proceed with the sale; in that case, the deposit is returned in full.

Platform Integrity

Shill bidding, coordinated bidding between multiple accounts, use of automated bidding tools, and any attempt to manipulate Auction outcomes are strictly prohibited and result in immediate and permanent account termination.

Buying a Vehicle

Vehicle purchases — whether by Auction or direct listing — are contracts between the Buyer and the Showroom. Maared provides the technical infrastructure, escrow of deposits where applicable, and dispute-mediation support, but is not itself the seller.

Buyers are responsible for conducting reasonable due diligence before purchase, including reviewing the vehicle report, requesting service records where available, and, where possible, inspecting the vehicle in person or through an authorized agent.

Ownership transfer, registration with the General Department of Traffic (Muroor), and insurance arrangements are the joint responsibility of the Buyer and the Showroom and must be completed in accordance with Saudi regulations.

All vehicles are sold on an “as-is” basis unless a written warranty is expressly issued by the Showroom. Maared does not provide any warranty, express or implied, regarding any vehicle sold through the Platform.

Showroom Owner Terms

Showrooms must hold a valid commercial registration, a Ministry of Commerce license to trade in vehicles, and any applicable municipal permits. Documentation must be submitted during onboarding and kept current.

Showroom access to the Platform is provided under one of three subscription tiers — Basic, Growth, or Enterprise — with listing quotas, auction allowances, and reporting features as specified at sign-up. Subscription fees are billed monthly in advance and are non-refundable for partial periods.

Listings must be accurate, complete, and reflect the true condition and specification of the vehicle. Misleading photographs, fabricated mileage, or undisclosed material damage constitute a material breach of these Terms.

Maared may remove any Listing that violates these Terms, applicable law, or Platform content policy, and may suspend or terminate Showroom accounts for repeated or serious violations without refund of subscription fees.

Payments, Fees & Taxes

All payments on the Platform are processed in Saudi Riyals (SAR) through licensed payment providers. Accepted methods include mada, Apple Pay, and major credit cards. Bank transfer is available for purchases above SAR 100,000 subject to verification.

A transaction service fee of 1.5% of the final purchase price, capped at SAR 2,500, applies to all vehicle purchases and is paid by the Buyer at checkout.

All applicable taxes — including Value Added Tax (VAT) at the rate set by the Zakat, Tax and Customs Authority (ZATCA) — are charged in addition to quoted prices and itemized on the final invoice.

Refunds, where due under these Terms, are issued to the original payment method within seven (7) to fourteen (14) business days depending on the provider.

Prohibited Conduct

You agree not to use the Platform to engage in any of the following:

Circumvention

Contacting a Showroom to complete a purchase outside the Platform after initial connection through Maared, with the intent to avoid fees.

Misrepresentation

Submitting false identity documents, impersonating another person, or creating multiple accounts to manipulate Auctions or reviews.

Scraping

Using automated means — including bots, crawlers, or scrapers — to access, copy, or monitor Platform content without prior written permission.

Harmful Content

Posting content that is unlawful under Saudi law, defamatory, obscene, or that infringes third-party rights.

System Interference

Attempting to probe, scan, or test the vulnerability of the Platform, or to breach security or authentication measures.

Intellectual Property

The Platform, including its design, logos, trademarks, text, graphics, software, and compilation of content, is the property of Maared Trading Company or its licensors and is protected by Saudi and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes or, in the case of Showrooms, for the commercial purposes expressly authorized by your subscription.

You may not copy, modify, distribute, sell, or lease any part of the Platform, nor reverse-engineer or attempt to extract the source code, except as permitted by applicable law.

Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal data in accordance with the Personal Data Protection Law (PDPL) of the Kingdom of Saudi Arabia.

By using the Platform you consent to the processing of your personal data as described in the Privacy Policy. You may exercise your rights of access, correction, and deletion by contacting us at privacy@maared.sa.

Liability & Disclaimers

The Platform is provided on an “as-is” and “as-available” basis. To the fullest extent permitted by Saudi law, Maared disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Maared is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or loss of business opportunity, arising out of or in connection with your use of the Platform.

Maared’s total aggregate liability to any user for any claim arising from these Terms or from use of the Platform shall not exceed the total fees paid by that user to Maared in the six (6) months preceding the event giving rise to the claim.

Dispute Resolution & Governing Law

These Terms are governed by and construed in accordance with the laws and regulations of the Kingdom of Saudi Arabia, with consideration given to the principles of Islamic Sharia.

Any dispute arising out of or in connection with these Terms shall first be addressed through good-faith negotiation between the parties. If not resolved within thirty (30) days, the dispute shall be referred to the competent courts of the city of Riyadh, which shall have exclusive jurisdiction.

Nothing in this Section limits a consumer’s statutory rights under applicable Saudi consumer protection laws.

Modifications to the Terms

Maared may update these Terms from time to time to reflect changes in law, business practice, or Platform features. The updated Terms take effect on the date posted on this page. Material changes will be communicated by email or in-app notice at least fourteen (14) days before they take effect.

Continued use of the Platform after the effective date of the updated Terms constitutes your acceptance of the revised Terms. If you do not accept the changes, you must stop using the Platform and may close your account.
